1. Acceptance of Terms
By downloading, installing, or using CalmWave ("the App"), you confirm that you are at least 18 years of age and that you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, please do not use the App. These Terms constitute a legal agreement between you and the App's developer, Suraj Kumar ("Developer," "we," or "us").
2. About CalmWave
CalmWave is a wellness-focused iOS application that provides working professionals with short, evidence-informed interventions for stress and mood management. The App combines binaural beat audio therapy, guided breathing exercises, yoga-inspired practices, and acupressure video guidance, all personalized through a mood-logging system. The App is grounded in modern neuroscience and traditional Indian wellness practices and is aligned with the United Nations Sustainable Development Goal 3: Good Health and Well-Being.
3. Account Registration
Use of CalmWave requires you to create an account using a valid email address. You are responsible for:
- Providing accurate registration information.
- Maintaining the confidentiality of your account password.
- All activity that occurs under your account.
- Notifying us immediately of any unauthorized use of your account.
Accounts are personal and non-transferable. You may not create an account on behalf of another person. We reserve the right to suspend or terminate accounts that violate these Terms.
4. Subscription Terms
CalmWave offers a free tier with limited access and optional auto-renewable subscription plans (Monthly and Annual) that unlock the full feature set, including the complete binaural beats library, all guided exercise videos, mood-based personalization, and playlist management.
- All subscriptions are billed through your Apple ID and managed via the Apple App Store.
- Subscriptions automatically renew at the end of each billing period unless cancelled at least 24 hours before the renewal date.
- Your Apple ID account will be charged for renewal within 24 hours prior to the end of the current subscription period.
- You may manage and cancel your subscription at any time through Settings → [Your Name] → Subscriptions on your iPhone.
- No refunds will be provided for any unused portion of a subscription period, except as required by applicable law or Apple's policies.
- If a free trial is offered, it will automatically convert to a paid subscription upon expiry unless cancelled before the trial period ends.
- We reserve the right to modify subscription pricing; any changes will be communicated in advance and will apply to new billing periods only.
5. Permitted Use
CalmWave is licensed to you for personal, non-commercial use only. You agree not to:
- Copy, reproduce, modify, or distribute any content from the App without written permission.
- Attempt to reverse-engineer, decompile, or extract the source code of the App.
- Use the App for any unlawful purpose or in violation of any applicable regulations.
- Create multiple accounts to exploit free trials or circumvent subscription requirements.
- Interfere with the App's servers, databases, or security features.
6. Mental Health Disclaimer

CalmWave is a wellness tool and is not a medical device, clinical therapy, or substitute for professional mental health care. The content within the App — including binaural beats, breathing exercises, yoga, and acupressure guidance — is intended for general wellness support and stress management only. It does not constitute medical advice, diagnosis, or treatment. If you are experiencing a mental health emergency, severe anxiety, depression, or any other clinical condition, please seek help from a qualified medical or mental health professional. By using the App, you acknowledge and accept that results may vary and that we make no clinical guarantees.
7. Intellectual Property
All content within CalmWave — including but not limited to the application design, audio tracks, video content, graphics, user interface elements, and written materials — is the intellectual property of the Developer or its licensed content providers, and is protected by applicable copyright and intellectual property laws. Unauthorized reproduction, redistribution, or commercial exploitation of any App content is strictly prohibited.
8. Disclaimer of Warranties
The App is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the App will be uninterrupted, error-free, or that any defects will be corrected.
9. Limitation of Liability
To the maximum extent permitted by applicable law, the Developer shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of or inability to use the App, including but not limited to loss of data, revenue, or profit. The Developer's total aggregate liability to you for any claim arising out of or related to these Terms or the App shall not exceed the amount you paid for your subscription in the 12 months preceding the claim.
10. Governing Law
These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law principles. Any disputes arising under these Terms shall be subject to the jurisdiction of the courts of Uttar Pradesh, India.
11. Changes to These Terms
We reserve the right to modify these Terms at any time. Material changes will be communicated through the App or by email. Your continued use of the App after the effective date of any changes constitutes your acceptance of the revised Terms. If you do not agree with the updated Terms, you may delete your account and uninstall the App.
