Terms of Use

1. About the App

Better Speak is an educational app that helps you practice speaking. It offers pronunciation practice, speaking-pace feedback, practice topics, daily challenges, tongue twisters, and progress tracking.

2. Eligibility

You may use the App if you can form a binding agreement under the laws of your country. If you are under the age of majority where you live, you may use the App only with the involvement and consent of a parent or legal guardian, who agrees to these Terms on your behalf.

3. License to Use the App

We grant you a personal, non-exclusive, non-transferable, revocable license to download and use the App on Apple devices that you own or control, for your own personal, non-commercial use, as permitted by these Terms and the Apple Media Services Terms and Conditions.

4. Acceptable Use

You agree not to:

• Copy, modify, distribute, sell, or rent any part of the App or its content
• Reverse engineer, decompile, or try to extract the App's source code, except where the law expressly allows it
• Use the App for any unlawful, harmful, or fraudulent purpose
• Interfere with or disrupt the App's normal operation
• Remove or alter any copyright, trademark, or other proprietary notices

5. Educational Purpose Only

The App is designed for practice and self-improvement. It is not a substitute for professional speech therapy, medical advice, or language certification. Feedback, scores, accuracy percentages, and speaking-pace levels (such as 🐴, 🐰, 🦁, 🐢, 🐌) are automated estimates generated with speech recognition technology. They may not always be accurate, and results can vary with your accent, background noise, microphone quality, and device. If you have concerns about a speech or communication disorder, please consult a qualified professional.

6. Microphone and Speech Recognition

Some features need access to your device's microphone and Apple's Speech Recognition service. By granting these permissions, you allow the App to listen while you actively practice. How this information is handled is described in our Privacy Policy.

7. Intellectual Property

The App and all of its content, including text, practice phrases, designs, graphics, characters, icons, logos, and software, are owned by us or our licensors and are protected by copyright, trademark, and other intellectual property laws. "Better Speak" and its associated logos and mascot are our trademarks. Nothing in these Terms transfers any ownership rights to you.

8. Your Data and Progress

Your practice progress is stored locally on your device. We do not provide cloud backup or account recovery. If you delete the App, change devices, or reset your device, your progress may be lost permanently. We are not responsible for any loss of locally stored data.

9. Updates and Availability

We may update, change, suspend, or discontinue the App or any feature at any time, with or without notice. Some updates may be required to keep using the App. We do not guarantee that the App will always be available, error-free, or compatible with every device or iOS version.

10. Disclaimer of Warranties

The App is provided "as is" and "as available", without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement, to the fullest extent permitted by law. We do not guarantee any specific improvement in your speaking skills.

11. Limitation of Liability

To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, arising from or related to your use of, or inability to use, the App. Our total liability for any claim related to the App will not exceed the amount you paid for the App (if any) in the 12 months before the claim. Some jurisdictions do not allow these limitations, so they may not fully apply to you.

12. Apple-Specific Terms

These Terms are between you and us, not Apple Inc. ("Apple"). Apple is not responsible for the App or its content. Apple has no obligation to provide maintenance or support for the App. If the App fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price (if any). To the maximum extent permitted by law, Apple has no other warranty obligation regarding the App. Apple is not responsible for addressing any claims relating to the App, including product liability claims, claims that the App fails to meet legal or regulatory requirements, or consumer protection claims. In the event of a third-party claim that the App infringes intellectual property rights, we, not Apple, are responsible for the investigation, defense, settlement, and discharge of that claim. You confirm that you are not located in a country subject to a U.S. Government embargo and are not on any U.S. Government list of prohibited or restricted parties. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

13. Termination

These Terms remain in effect until terminated. Your rights under these Terms end automatically if you fail to comply with them. You may stop using the App at any time by deleting it from your device.

14. Governing Law

These Terms are governed by the laws of India, without regard to its conflict-of-law rules. Any disputes will be resolved in the courts located in Uttar Pradesh, India, unless the laws of your country of residence require otherwise.

15. Changes to These Terms

We may update these Terms from time to time. When we do, we will change the "Effective date" above. Continuing to use the App after changes take effect means you accept the updated Terms.
